Terms of Service
Effective October 15, 2026
These terms are an agreement between Car10x ("Car10x", "we", "us") and the business that creates a Car10x account ("you"). They cover the Car10x app, the AI receptionist for calls, texts, and website chat, online booking and payments, websites, memberships, marketing, and related services (the "Services"). By creating an account, starting a trial, or using the Services, you agree to these terms on behalf of your business, and you confirm you're authorized to do so.
1. Your account
- The Services are for businesses, not for personal or household use.
- Keep your account details accurate and your sign-in credentials secure. You're responsible for everything done in your account, including by the team members you invite. Tell us right away atsupport@car10x.com if you suspect unauthorized access.
- We may review new accounts before switching on phone numbers or messaging, and we may decline an account for any lawful reason.
2. Free trial
- Each business may start one free trial. A payment card is required to start it. The trial's length is shown before you start.
- Unless you cancel before the trial ends, your subscription starts automatically when it ends and your card is charged the plan's monthly fee.
- Usage during the trial is not charged as extra usage.
3. Subscription, usage charges, and fees
Monthly fee
Your plan has a monthly fee, billed in advance each month to the card on file, and renews automatically until you cancel.
Usage allowances and extra usage
Your plan includes monthly allowances, which may include owners or managers, AI call minutes, AI replies to texts and website chats, and marketing texts. Usage beyond an allowance in a billing period is charged at the per-unit rates for your plan and added to your next invoice. Your plan's allowances, rates, and your current usage are shown in the app under Settings › Billing. Front-desk team members are not counted toward the manager allowance.
Fee on payments
When your customers pay you through Car10x (for example, deposits, bookings, memberships, and gift cards), Car10x charges a fee of a percentage of each payment, as shown for your plan in the app. It's deducted automatically from the payment through Stripe. This is in addition to Stripe's own processing fees.
Taxes
Fees don't include taxes. You're responsible for applicable taxes, and we'll add them to invoices where we're required to collect them.
Late or failed payments
If a payment fails, we'll let you know so you can update your card. If it isn't resolved, we may suspend the Services, including answering calls and sending messages, until it is.
Changes to prices
We may change prices, allowances, or rates. We'll give you at least 30 days' notice by email or in the app, and the change will apply from your next billing period after the notice. If you don't agree, you can cancel before it takes effect.
4. Cancelling
- You can cancel any time in Settings › Billing. Cancellation takes effect at the end of the current billing period, and the Services continue until then.
- Fees already paid are not refunded, including for a partial month, except where the law requires a refund. Extra usage from the final period is still billed.
5. Taking payments from your customers
- Payments from your customers are processed by Stripe through your own Stripe account, which you connect to Car10x. Your use of Stripe is subject to Stripe's terms, including theStripe Connected Account Agreement.
- You are the seller to your customers. You're responsible for your prices, taxes, receipts, refunds, chargebacks, and the services you provide, and for honouring memberships and gift cards you sell.
6. Calls, texts, and email
You're responsible for how you use Car10x to communicate with people, and for complying with the laws that apply, including Canada's Anti-Spam Legislation (CASL), the U.S. Telephone Consumer Protection Act (TCPA), and carrier rules for business texting. In particular, you agree to:
- Send marketing messages only to people who have given the consent the law requires, and keep accurate consent records. Car10x records consent and opt-outs it receives, but you're responsible for consent you collect elsewhere, such as at your counter or in imported customer lists.
- Honour opt-outs. Car10x stops texts to people who reply STOP; don't contact them by other means against their wishes.
- Tell callers when calls may be recorded or transcribed where required. The AI receptionist's default greeting says so; if you change the greeting, keep that notice where the law requires it.
- If you turn on recording of transferred calls, decide that it's appropriate for you and give any notice or get any consent the law requires (Car10x tells callers the call may be recorded before putting them through, and tells your staff in their heads-up text). Recordings are deleted for good after the number of days you choose and can't be recovered: download any you need to keep before then. Recorded minutes are charged at the price shown in your account.
- Provide accurate business information for text-messaging registration (such as A2P 10DLC in the U.S.), and cooperate with carrier and provider requirements. Carriers may filter or block messages, and delivery isn't guaranteed.
- Not use the Services for spam, harassment, or unlawful, deceptive, or harmful content.
7. Phone numbers
Phone numbers Car10x provides for your account are obtained through our telecommunications providers and are for use with the Services. If your account is closed, those numbers may be released. If you'd like to keep a number, contact us before closing your account and we'll help where our providers allow. If you forward an existing number to Car10x, you remain responsible for that number with your own carrier.
8. The AI receptionist and AI features
- The AI receptionist and other AI features generate responses automatically from the information you provide, such as services, prices, hours, policies, and instructions. Keep that information accurate.
- AI can make mistakes, for example quoting a wrong price or misunderstanding a caller. Review conversations and bookings, and use the settings that suit your business, such as requiring staff approval for bookings. You're responsible for the commitments your business makes to customers.
- AI features use third-party models, as described in our Privacy Policy.
9. Your data
- You own the information you and your customers put into Car10x ("Your Data"). You give Car10x permission to use Your Data to provide, secure, and support the Services, as described in ourPrivacy Policy.
- You're responsible for having the right to provide Your Data to us, and for your own privacy notices to your customers. Car10x handles your customers' information on your behalf.
- After your account is closed, you can ask us for a copy of Your Data or to delete it, subject to records we must keep by law.
- We may use aggregated and de-identified information that doesn't identify you or your customers to operate and improve the Services.
10. Websites and content
- You're responsible for the content on websites you build with Car10x, including text, photos, and logos, and for having the rights to use it. When you import content from a website, import only content you have the right to use.
- If you connect your own domain, you're responsible for that domain and its registration.
- You may add analytics, tag manager, or other tracking code (such as advertising pixels) to your website. You're responsible for that code and the providers you use; for telling your visitors what's collected, in your own privacy notice; and for getting any consent the law requires, such as for cookies. To protect Car10x accounts, Tag Manager and custom code run only when your website is on your own domain.
- We may remove content or disable code that is unlawful, harmful, or violates these terms, or that puts visitors or the Services at risk.
11. Acceptable use
You agree not to:
- Use the Services unlawfully or to infringe others' rights.
- Interfere with, disrupt, or try to gain unauthorized access to the Services or other accounts.
- Add code to a website that is malicious, deceptive, or collects information unlawfully, or that targets visitors' devices or other accounts.
- Reverse-engineer the Services, except where the law allows it, or copy them to build a competing product.
- Resell the Services without our written permission.
12. Third-party services
The Services rely on providers such as Twilio, Stripe, Anthropic, and Google, and you may connect others, like Google Calendar. Their services are subject to their own terms. We're not responsible for outages or changes on their side, though we'll work to keep the Services running.
13. Car10x's property
Car10x and its licensors own the Services, including the software, design, and trademarks. We give you a limited, non-exclusive, non-transferable right to use the Services for your business while your account is active. If you send us feedback, we may use it without obligation to you.
14. Suspension and termination
We may suspend or close your account if you materially break these terms, don't pay, or use the Services in a way that risks harm to people, our providers, or the Services. Where reasonable, we'll give you notice and a chance to fix the problem first. Sections that by their nature should survive, such as fees owed, your data, disclaimers, and limits of liability, survive termination.
15. Disclaimers
The Services are provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Services will be uninterrupted or error-free, that every call will be answered, or that every message will be delivered.
16. Limitation of liability
To the extent the law allows, Car10x won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, customers, or data. Car10x's total liability for any claims relating to the Services is limited to the amounts you paid Car10x in the 12 months before the event giving rise to the claim.
17. Indemnity
You'll defend and indemnify Car10x against claims by third parties arising from Your Data, your content, your communications with your customers (including consent and opt-outs), the services you sell, or your breach of these terms or the law.
18. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have exclusive jurisdiction.
19. Changes to these terms
We may update these terms. We'll post the new version here with a new effective date and, for significant changes, notify you by email or in the app at least 30 days before they take effect. Continuing to use the Services after that means you accept the updated terms.
20. General
These terms and our Privacy Policy are the entire agreement between us about the Services. If part of these terms is unenforceable, the rest still applies. Not enforcing a right isn't a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a merger, acquisition, or sale of assets. Neither of us is responsible for delays caused by events beyond reasonable control.
